The present writ petition came to be filed seeking issuance of writ of Mandamus declaring the action of the respondents in not mutating their names in the revenue records and issuing pattadar passbooks basing on the registered sale deeds dated 29.06.2010, as arbitrary and illegal. The case of the petitioners is that they are the absolute owners of the land in Survey No.111 to an extent of Acs.5.22 guntas and in Survey No.114 to an extent of Acs.4.28 guntas and Acs.9.34 guntas situated at Pedda Korakondi Village, Kallur Mandal, Khammam District. The said land was purchased from Madiraju Saraswathi, Jaganadharao and Prasadarao. The petitioners made representations to the Tahsildar, Kallur, Khammam District for mutation of their names in the revenue records under A.P. (Rights in land) and Pattadar Passbooks Act, 1971 (for short 'the Act').
It is stated that though a representation was made on 11.08.2011 till date no order has been passed mutating their names in the revenue records by transferring the patta in their name. Learned counsel for the petitioners by restricting his contention submits that the 3rd respondent may be directed to dispose of the representations dated 11.08.2011 made by the petitioners at the earliest. Learned Government Pleader for Revenue submits that he has no objection for the same, if the same is still pending. Having regard to the facts and circumstances of the case and without going into the merits of the case, the Writ Petition is disposed of by directing the 3rd respondent to dispose of the representations dated 11.08.
2011 made by the writ petitioners seeking mutation of their names in the lands referred to above, if it is still pending, in accordance with law, within eight weeks from the date of receipt of a copy of this order.
