HON'BLE SRI JUSTICE T. VINOD KUMAR WRIT PETITION NO.20792 OF 2019 ORDER:
This Writ Petition is filed to declare the action of the 2nd respondent in maintaining silence and adopting delay tactics in investigation into Crime No.75 of 2019 dated 18.07.2019 in collusion with respondent Nos.5 and 6 and threatening to dispossess the petitioner from his land in Sy. No.628 admeasuring to an extent of Ac.7.05 gts of Phangiri village, Nagaram Mandal, Suryapet District as being illegal, arbitrary and unjust.
Heard learned Counsel for the petitioner and learned Assistant Government Pleader for Home and Sri D.L. Pandu, learned Counsel appearing for respondent Nos.5 and 6. The case of the petitioner in the present proceeding is that the 2nd respondent is not investigating into the crime which has been registered, based on the complaint made by the petitioner, wherein it is alleged that the respondent Nos.5 and 6 have illegally trespassed into his agricultural land and further damaged the seed that has been sown.
Learned Assistant Government Pleader for Home on the basis of the written instructions dated 23.09.2019, a copy of which is placed on record before this Court, would submit that upon the complaint by one Jangili Raghuram, a case in
Crime No.75 of 2019 has been registered in the 2nd respondent police station. Upon registration of the case, the authority took up investigation and in the course of investigation, L.Ws-1 to 11 were examined. Notice under Section 41-A Cr.P.C. was served to the accused person and after completion of investigation, a charge sheet was filed on 23.09.2019 before the Judicial Ist Class Magistrate, Thungathurthy and the C.C. number is awaited. Since the grievance of the petitioner in the present Writ Petition is relating to the maintenance of silence and delay tactics in investigating into the crime by the 2nd respondent, which in view of the facts recorded above, appears to be incorrect, no further orders need be passed in this Writ Petition.
Accordingly, this Writ Petition is closed. No order as to costs.
As a sequel, the miscellaneous petitions pending, if any, shall stand closed.
