THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No. 17416 of 2015 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for the respondents.

2. The petitioner was appointed as a Fair Price Shop Dealer of Shop No.2 of Kalluru Village, Kurichedu Mandal, Prakasam District. While so, the Enforcement Deputy Tahsildar, Darsi, seized the stock and conducted a panchnama on 16.02.2015. Basing on the report of the Enforcement Deputy Tahsildar, Darsi, a show cause notice was issued by the 3rd respondent to the petitioner on 02.04.2015 and it was served on him on 21.04.2015. In order to submit a proper explanation, the petitioner filed a petition on 27.04.2015 requesting for a copy of the report. However, a copy of the report was not furnished, but the impugned order was passed on 30.04.2015 suspending the authorization pending further enquiry. Challenging the same, the present writ petition is filed.

3. The petitioner submitted his explanation on 22.05.2015 and also filed an appeal against the impugned order to the appellate authority on 05.06.2015. However, this Court sees no reason to interfere with the present order of suspension, since the main enquiry itself can be completed by the 3rd respondent, in view of the lone charge levelled against the petitioner. The writ petition is disposed of, directing the 3rd respondent to complete the enquiry keeping in view the explanation submitted by the petitioner and after observing the principles of natural justice, and pass final orders within a period of 30 days from the date of receipt of a copy of the order.

4. The Writ Petition is accordingly disposed of. Miscellaneous petitions, if any, pending in the writ petition shall stand closed. There shall be no order as to costs.
