HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.18239 of 2018 ORDER:

It is stated by learned counsel for the petitioner that the petitioner gave oral complaint that he was beaten blue and black by the relatives of his wife and in respect of said incident a case under Section 70-B of City Police Act was registered. But no action has been taken by the respondents. Aggrieved by the same, the present writ petition is filed.

Learned Assistant Government Pleader for Home on instructions submits that no written complaint was filed by the petitioner.

Learned counsel for the petitioner says that oral complaint was given.

It is to be seen that if the petitioner is serious enough on the alleged incident, he could have filed written complaint alleging injuries sustained by him.

In view of the same, it is open for the petitioner to make complaint to the police and the police shall consider the same in terms of the judgment of Apex Court in Lalitha Kumari v. Government of Uttar Pradesh1.

Accordingly, the writ petition is disposed of. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
