HON'BLE SRI JUSTICE S. RAVI KUMAR Tr.CIVIL MISCELLANEOUS PETITION No.525 of 2015 ORDER:
This petition is filed to withdraw O.P.No.226 of 2015 from the file of District Judge, Nizamabad and transfer the same to VIII Additional District Judge at Medak District.
2. Wife filed this petition. According to her affidavit her marriage with respondent was performed on 22.11.2010 at Konapur, Medak District as per Christian Community in a church and petitioner joined respondent to lead conjugal life and thereafter due to disputes she is living at Medak and respondent filed divorce petition before District Court, Nizamabad. She further stated that she is not able to meet the travel expenses from Medak to Nizamabad to defend divorce proceedings. She further stated that there are none to accompany her from Medak to Nizamabad, therefore, OP No.226 of 2015 has to be withdrawn from District Court, Nizamabad and transferred to VIII Additional District Judge at Medak District.
3. On 05.01.2016, this Court permitted petitioner to take out personal notice to respondent through registered post with acknowledgment due and to file proof of service. Advocate for petitioner submitted that petitioner sent registered notice on 19.03.2016 to respondent but till now the postal acknowledgement is not received. As per the track report of BSNL, notice was delivered to respondent on 23.03.2016. Advocate for petitioner further submitted that it is mentioned in the affidavit that OP has to be transferred to VIII Additional District Judge, Medak and the same may be transferred to Principal District Judge, Medak at
Sangareddy, as divorce OP is filed under Special Act.

Considering the reasons stated in the affidavit filed in support of the petition and also considering the submissions of advocate for petitioner, O.P.No.226 of 2015 is withdrawn from the file of District Judge, Nizamabad and transferred to Principal District Judge, Medak District at Sangareddy for disposal in accordance with law.
6. Accordingly, this Transfer Civil Miscellaneous Petition is ordered. No costs. As a sequel, miscellaneous petitions, if any filed in this civil miscellaneous petition, shall stand closed. __________________ S. RAVI KUMAR, J Date: 04-04-2016 gvl
