THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.8501 of 2016 ORDER:

The prayer of the petitioner in this case is as under: "For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon'ble Court may be pleased to Issue a writ or order more particularly one in the nature of Writ of Mandamus declaring the proceedings of the 2nd respondent Dt:12-02-2016 as illegal arbitrary and violative of principles of natural justice and consequently set aside the same and direct the respondents not to demolish the premises bearing No.18/507, MM Road, Adoni Municipality and to pass such other order or orders as this Hon'ble Court may deems fit just and proper in the circumstances of the case."

Sri K. Sita Ram, learned counsel for the petitioner, and Sri Md. Saleem, learned Standing Counsel for the 2nd respondent - Adoni Municipality, are in agreement that the issue raised in this writ petition is squarely covered by the decision rendered by this Court in W.P.No.3041 of 2016. A copy of the order dated 03.02.2016 passed in the said writ petition is placed on record.

For reasons alike as were stated in the afore-stated order and in terms thereof, the writ petition is disposed of permitting the petitioner to submit a representation within one week from today. On receipt of such representation, the 2nd respondent - Municipality shall consider the same and take a decision thereon. The decision shall be communicated to the petitioner before proceeding further pursuant to the impugned notice.
