The petitioner was appointed as Fair Price Shop dealer of Shop No.24 of Orvakallu Village, Atchampet Mandal, Guntur District, on 03.11.2008. The authorization of the petitioner was suspended on 28.02.2015 on the basis of the report submitted by the Tahsildar dated 20.02.2015. Challenging the same, the present Writ Petition is filed.

Since the allegations in the order of suspension relates to issuance of less quantity than the permitted quantity to the cardholders and the enquiry is pending before the second respondent, this Court is not inclined to interfere with the order of suspension dated 28.02.2014 at this stage. However, the petitioner is given liberty to submit an explanation if the second respondent has issued a show cause notice within a period of fifteen (15) days from the date of receipt of a copy of this order. The second respondent shall conduct enquiry in respect of the allegations against the petitioner and pass final orders thereon with in a period of sixty (60) days from the date of receipt of explanation from the petitioner. The Writ Petition is, accordingly, disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, pending shall stand closed. ________________________
