.....Respondents Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed herein, the High Court may be pleased to issue a writ, direction or order especially in the nature of mandamus declaring the unilateral acts of the Respondent no. 2 in declining the permission to the Petitioner to appear for one theory exam which is Structural Mechanics-I which carries 2 credits required for being promoted to the IV Year of Architecture in the ensuing semester exams to be commencing from 05-02-2015 as highly illogical, irrational, illegal, and arbitrary and against the Principles of natural justice. The petition coming on for hearing, upon perusing the Petition and the affidavit filed herein and upon hearing the arguments of SRI N. HARINATH, Advocate for the Petitioner, GP for Higher Education for Respondent No.1 and of Sri A. Abhisekh Reddy, Standing Counsel for Respondent No.2 and the Court made the following. ORDER:

Heard the learned counsel for the petitioner and Sri A. Abhisekh Reddy, learned Standing Counsel for the respondents.

The petitioner seems to have suffered spinal cord surgery and on account of medical reasons, he requested the 2nd respondent to permit him for registration of two studious and one theory subject and the University is stated to have agreed to his request so far as two studious are concerned, but not with regard to theory subject. Hence, the present writ petition is filed contending that examination of theory subject shall be held at 2.00 p.m. today and the petitioner seeks a direction to the 2nd respondent to enable the petitioner to appear for the said examination.

Since the petitioner has approached this Court at 11th hour, for the present, it is directed that the 2nd respondent shall permit the petitioner to appear for theory examination scheduled today at 2.00 p.m. but shall not declare the result of the said examination.

In the meanwhile, the learned Standing Counsel to get instructions in the matter.
