When the matter is taken up for hearing, learned counsel appearing for the petitioner submits that in view of amendment to Rules 4 (b) and 14 of G.O.Ms.No.189, SW(A2) Department, dated 31.12.1997, the cause in the writ petition does not survive for adjudication.

In view of the said submission, the Writ Petition is dismissed as infructuous. However, liberty is given to the petitioner to challenge the said amended Rules 4 (b) and 14 of G.O.Ms.No.189, SW(A2) Department, dated 31.12.1997. No costs.

Miscellaneous petitions, pending, if any shall stand closed.
