THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.7475 OF 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused No.1 in Crime No.57 of 2023, on the file of Sangem Police Station, Warangal District, registered for the offence under Section 302 of IPC.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondentState and perused the record. 3.

The petitioner is A-1 arrested for the alleged murder of his mother. The case of the prosecution is that the deceased was found murdered beside the main road near the agricultural land of one Yellaiah. The Police having received the information started investigation and after completion of investigation, the Police came to a conclusion that this petitioner in association with A-2 killed the deceased. The motive according to the Police

was that the deceased was having extra marital relations with other persons for which reason, the petitioner being the son, took the assistance of A-2 and killed the deceased.

Learned Additional Public Prosecutor would submit that investigation is complete and charge sheet is already filed. Further, A-2 was granted bail.

Since the investigation is complete and A-2 who is standing on the same footing was granted bail, this Court deems it appropriate to grant relief of regular bail to the petitioner subject to following conditions:

i) The petitioner/Accused No.1 shall execute personal bond for a sum of Rs.20,000/- (Rupees Twenty thousand only) with two sureties for a like sum each to the satisfaction of II Additional Judicial First Class Magistrate, Warangal.

ii) The petitioner/Accused No.1 after release shall appear before the concerned Court on every date of hearing.

iii) The petitioner/Accused No.1 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, pending if any, shall stand closed.
