THE HONOURABLE SRI JUSTICE P. KESHAVA RAO WRIT PETITION No.11578 of 2013 ORDER:

Heard learned counsel for the petitioner as well as respondents. 2.

The prayer sought in the writ petition is as under:- "...to issue an order or direction more particularly one in the nature of Writ of Mandamus declaring that the action of the respondents 1 and 2 in threatening the petitioner with dire consequences at the instance of 3rd respondent and interfering with petitioner's possession of the premises bearing No.16-3-829/A, Ekashila Nagar, Fort Road, Warangal and also threatening the petitioner to settle the matter with the 3rd respondent is highly arbitrary, bad and illegal..."

Learned Government Pleader, during the course of arguments, placed on record the written instructions, dated 25.04.2013, issued by the Station House Officer, A.J. Mills Colony Police Station, Warangal District.

From the perusal of the said written instructions, it is revealed that the respondent police never harassed, threatened and interfered with the petitioner's possession in premises bearing No.16-3-829/A, Ekashila Nagar Fort Road, Warangal District, at any point of time. In fact, it is mentioned that at the instance of the 3rd respondent herein, a case in Crime No.53 of 2013 for the offences under Sections 454, 385 and 506 IPC has been registered on 19.02.2013 against the petitioner on the file of the A.J. Mills Colony Police Station, Warangal, and on

21.02.2013, the petitioner/accused has been surrendered before the Station House Officer, A.J. Mills Colony Police Station and remanded to judicial custody. It is specifically mentioned that at no point of time, the respondent police harassed and threatened the petitioner to settle the matter with the 3rd respondent. Except registering the crime against the petitioner on the complaint lodged by the 3rd respondent, the respondent police never interfered with the petitioner's property.

Taking the above facts and circumstances into consideration, this Court is of the opinion that there are no merits in the writ petition and the same is liable to be closed.

Accordingly, the writ petition is closed.

Miscellaneous petitions pending, if any, shall stand closed. No costs.
