HONOURABLE JUSTICE G. SRI DEVI I.A.Nos.3 and 4 of 2019 in/and Criminal Petition No.6046 of 2019 ORDER:
The petitioners, who are A.1 to A.3 in C.C.No.736 of 2016 on the file of the XIII Additional Chief Metropolitan Magistrate at Nampally, Hyderabad, of Cr.No.414 of 2016 on the file of the Station House Officer, Woman Police Station, CCS, DD, Hyderabad, registered for the offences punishable under Sections 498-A and 406 IPC and under Sections 4 and 6 of the Dowry Prohibition Act, filed this Criminal Petition under Section 482 CrPC to quash the proceedings in the above case. 2.
Both the petitioners and the defacto-complainant along with their respective counsel present and the parties were identified by their respective counsel. When examined they stated that they intend to compromise the matter pending criminal petition and filed petitions seeking to permit them to compromise the matter and quash the proceedings against the petitioners in view of the compromise.

Perused the petitions vide I.A.Nos.3 and 4 of 2019 filed by the defacto-complainant for permission to compromise the matter with the petitioners and compound the offences in the above case against the petitioners. The joint memo supported by the affidavit of the defactocomplainant, duly signed by both the parties along with their respective counsel, shows that they have amicably settled the matter out of Court by entering into Memorandum of Compromise,dt.20.07.2019 wherein they agreed for mutual divorce and in this regard also filed O.P.No.336 of 2018 under Section 13-B of the Hindu Marriage Act, on the file of the Judge, Addl.Family Court, Hyderabad and the same is also allowed by order, dt.30.08.2019 by granting divorce on mutual consent on receiving
an amount of Rs.23,00,000/ -(Rupees twenty three lakhs only) in total towards permanent alimony by the defacto-complainant from the petitioners. The certified copy of the said order forms part of the record.

Thus in view of the compromise between the parties by virtue of the Memorandum of Compromise,dt.20.07.2019 and the order, dt.30.08.2019 in O.P.No.336 of 2018, the compromise is recorded and the offences alleged against the petitioners are compounded. 5.
Accordingly, I.A.Nos.3 and 4 of 2019 are allowed and the Criminal Petition is also allowed quashing the proceedings in C.C.No.736 of 2019 on the file of the XIII Additional Chief Metropolitan Magistrate at Nampally, Hyderabad, against the petitioners. The petitioners/ A.1 to A.3 are acquitted and their bail bonds, if any, shall stand cancelled. 6.
