HON'BLE SRI JUSTICE S. RAVI KUMAR TRANSFER C.M.P. No. 276 of 2016 ORDER:

This petition is filed to withdraw F.C.O.P.No.1323 of 2013 from the file of Family Court, City Civil Court, Hyderabad, and transfer the same to Family Court, Ranga Reddy District at L.B.Nagar.

2. Wife filed this petition. According to her affidavit, her marriage with respondent was performed on 15.12.2010 at Hyderabad as per Hindu rites and custom. She stated that respondent and his parents started harassing her and treated her like a maid servant and that respondent neglected her and her child. She further stated that she lodged a complaint before Saroornagar Police Station, which is registered as Crime No.85 of 2013 and that she also filed a domestic case and the same is pending before XIV Metropolitan Magistrate, Cyberabad. She stated that she filed M.C.No.79 of 2016 before Family Court, Ranga Reddy District at L.B.Nagar, as she is unable to maintain herself and her child. She stated that she is living on the mercy of her relatives and residing in the paternal uncle's house in Mohan Nagar, Kothapet, and facing difficulty to attend the City Civil Court at Erramanjil for each and every adjournment with small baby. She stated that Family Court, Ranga Reddy is located at a distance of 1 1⁄2 km. from her residence, for these reasons she prayed for

transfer of F.C.O.P.No.1323 of 2013 from Family Court, City Civil Court, Hyderabad to Family Court, Ranga Reddy.

3. Advocate for petitioner filed memo stating that notice sent to respondent is returned unserved with an endorsement 'unclaimed', but notice sent to respondent through Registry is duly served.

In spite of that respondent is neither appeared in person nor through any advocate.

4. Heard arguments.

Considering the reasons stated in the affidavit filed in support of petition and also considering the fact that M.C. filed by petitioner is pending before Family Court, Ranga Reddy, request of petitioner for transfer of F.C.O.P.No.1323 of 2013 from Family Court, City Civil Court, Hyderabad, to Family Court, Ranga Reddy, is considered.

6. For these reasons, F.C.O.P.No.1323 of 2013 is withdrawn from Family Court, City Civil Court, Hyderabad, and transferred to Family Court, Ranga Reddy at L.B.Nagar, for disposal in accordance with law.

7. Accordingly, this transfer C.M.P. is ordered.

8. Miscellaneous petitions pending, if any, shall stand closed.
