O R D E R

Alleging that respondents 4 and 5, who are Circle Inspector of Police and Sub Inspector of Police, Mancherial Police Station, Mancherial, are interfering with the civil dispute between the petitioner and the 6th respondent, and insisting him to settle the dispute, the present writ petition is filed.

Heard the learned counsel for the petitioner. Learned Assistant Government Pleader for Home produced the written instructions of the 5th respondent dated 08.06.2018 denying the allegations of the petitioner. The relevant portion of the same, is extracted as under:

" It is submitted that the 6th respondent herein has given a complaint on 21.4.2018 with PS : Mancherial stating that, he purchased 16 1⁄2 guntas land in Sy.No.338 situated at Old Garmilla, Mancherial from Khaja Tajuddin, r/ o Jagtiyal, made it into plots and sold to prospective purchasers. Meanwhile, Mission Kakatiya pipeline was laid through the said plots, thereby the purchasers demanded to repay their amounts. Upon which, he filed complaint against the petitioner / Khaja Tajuddin for recovery of his purchase amount. It is submitted that based on the contents of above complaint, a GD entry was made in the station records and enquired into the matter. On 28.04.2018, both the petitioner and the 6th respondent attended the enquiry. The enquiry revealed that the subject matter is purely civil in nature.

As such, both the parties were informed to settle their dispute before the concerned civil court. Thereafter, the 6th respondent has not approached the police station or the petitioner was called to the police station. The allegations to the contrary made in the affidavit are all false, baseless and hereby denied. The Mancherial Police are not calling the petitioner to the police station or making him to settle the dispute with the 6th respondent, as alleged by the petitioner. The police also not insisted the petitioner to pay Rs.25 lakhs to the 6th respondent as alleged by the petitioner. The allegation that the police have taken signature of the petitioner on blank stamped papers is false, baseless and hereby denied."

Recording the above statement of the 5th respondent in the written instructions, the writ petition is disposed of. Miscellaneous petitions pending, if any, shall stand closed. No costs. ------------------------------------------ A.RAJASHEKER REDDY,J DATE:15-06-2018 AVS
