The present writ petition came to be filed seeking issuance of writ of Mandamus declaring the inaction of respondent-police in taking up investigation in Crime No.215 of 2015 of II Town Police Station, Kakinada, East Godavari District registered for the offences punishable under Sections 354, 448, 323 and 290 read with Section 34 IPC, as illegal and arbitrary. 3.
At the time when the matter is taken up for hearing, learned Government Pleader on instructions states that the police have conducted investigation and submitted proposals to SubDivisional Police Officer, Kakinada to refer the case as false. Thereby, the Sub-Divisional Police Officer issued proceedings vide C.No.972/PRO/SDPO-K/2015, dated 31.12.2015. It is further stated that after issuing a notice on the informant, final report was filed before the Court vide S.R.No.2168 of 2017, dated 25.04.2017.

That being the position, the request made by the petitioner in this writ petition cannot be granted and the writ petition is liable to be dismissed.

Accordingly, the writ petition is dismissed giving liberty to the petitioner to avail the remedies available under law. No costs.
