HON'BLE JUSTICE G. SRI DEVI CRIMINAL PETITION No.6099 of 2019 ORDER :

Petitioner, who is the accused in Cr.No.296 of 2019 on the file of the S.H.O. Balanagar Police Station, Cyberabad District, registered for the offences punishable under Sections 498-A and 306 IPC, filed this petition under Sections 437 and 439 Cr.P.C. seeking regular bail. 2.

Heard learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the respondent State.

Learned counsel for the petitioner submits that the petitioner is the innocent of the offence alleged and he has been falsely implicated by the de facto complainant. He further submits that absolutely, there is no material to show that the petitioner had any intention to abet the deceased-G.Pravallika to commit suicide. He further submits that the deceased informed her mother through phone call on 17.08.2019 stating that she is happy with her husband, which shows that the petitioner and the deceased were living together happily and the petitioner never harassed the deceased either physically or mentally nor abetted the deceased to commit suicide. The petitioner is in custody since 19.08.2019 without his fault and he is ready to abide by the conditions imposed by this Court, if

he is released on bail and hence, he prays to grant bail to the petitioner.

On the other hand, the learned Additional Public Prosecutor representing the State vehemently opposed the bail application.

As seen from the contents of the remand report, there are specific allegations against the petitioner that the marriage of the petitioner with the deceased was performed on 16.12.2018 and at the time of the death of the deceased, she was six months pregnant and her parents also performed Srimantham ceremony just before her death. Thereafter, the petitioner started harassing the deceased both mentally and physically by suspecting her character. Just two days prior to her death, the deceased made a phone call to her parents showing her apprehension due to cruel behaviour of her husband. On the intervening night of 17/18.08.2019 due to harassment and abetment made by her husband, she committed suicide by hanging with her chunni to Ceiling fan in hall and died on the spot. 6.

Thus, due to harassment by the petitioner, both mentally and physically by suspecting her character, the deceased committed suicide while she was staying in her in-laws house just within one year of her marriage with the petitioner. The death of the deceased was occurred in unnatural circumstances.

Thus, looking into the nature of allegations leveled against the petitioner and involvement of the petitioner in the crime, I am not inclined to grant bail to the petitioner.
