HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.9835 of 2016 ORDER:
This petition is filed by the petitioner/Accused under Sections 437 & 439 of Criminal Procedure Code seeking to grant bail in Crime No.152 of 2016 of III Town (L &O) Police Station, Rajahmundry (U), registered for the offence punishable under Section 8(a) (c) read with 20(b)(ii) (C) of the NDPS Act.
2. Heard and perused the material available on record.
3. The allegation against the petitioner is that he was found in possession of 1160 kgs., of ganja.
4. Learned counsel for the petitioner submitted that the petitioner was arrested on 23.03.2016 and that he is innocent of the offence alleged against him.
5. Learned Public Prosecutor submitted that while the police were conducting vehicle checking, they found Bolero-G bearing registration No.AP-16-DC-9227 and TATA lorry bearing No.AP-37-3534 and on suspicion they searched the vehicles and found the accused persons in possession of 1160 Kgs., of ganja.
6. Considering the above facts and circumstances of the case and the submissions of the learned Public Prosecutor and since the ganja seized is commercial quantity, this Court is not inclined to grant bail to the petitioner at this stage.
