THE HON'BLE SRI JUSTI CE SANJAY KUMAR CONTEMPT CASE NO.2133 OF 2016

O R D E R

This contempt case was instituted alleging willful disobedience to the order dated 09.03.2016 passed by this Court in W.P.No.7554 of 2016. By the said order, this Court directed the Greater Hyderabad Municipal Corporation to consider the petitioner's representations dated 23.02.2015, 11.02.2016 and 22.02.2016 and take appropriate action in the matter, if warranted, in accordance with law after hearing all parties who would be affected by any decision taken thereupon.

The Assist City Planner, Circle-18, Greater Hyderabad Municipal Corporation, filed a counter stating that pursuant to the aforestated order, notice was given to all parties concerned and as K.V.R. Murthy failed to attend the hearings, further action was initiated by issuing show-cause notices dated 21.11.2016 and 22.12.2016 under Sections 452 and 461 of the Hyderabad Municipal Corporation Act 1955, followed by a final notice under Section 636 thereof on 05.06.2017.

As the Corporation has taken appropriate action upon the petitioner's representations and initiated necessary action, this Court finds no cause made out for exercise of contempt jurisdiction.
