THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.5333 OF 2013 ORDER:
This petition is filed by the petitioner-accused under Section 482 Cr.P.C. seeking to quash the proceedings against him in F.I.R.No.97 of 2013 on the file of Nellore III Town Police Station, Nellore. When this matter has come up for hearing, the learned Public Prosecutor submitted that after completion of the investigation in the above crime, charge sheet was filed and therefore, nothing survives for adjudication in this petition and the petition has become infructuous. From the material on record, it is obvious that no stay was granted by this Court. Therefore, the police proceeded with the investigation and filed the charge sheet. If the petitioner is aggrieved over the same, he is always at liberty to file a fresh petition. Recording the above submission, this Criminal Petition is dismissed as infructuous. Consequently, the miscellaneous petitions pending, if any, shall stand dismissed.
