This petition is filed for a writ of Mandamus declaring the action of the 1st respondent in not passing the orders pursuant to the report submitted by the 2nd respondent in proceedings dated 26.07.2011 with a request to cancel the pattadar pass books and title deeds granted in favour of the 4th respondent herein, wrongfully based on the wrongful reports given by the Village Revenue Officer and Mandal Revenue Officer, Dummugudem in respect of the lands belonging to the petitioner herein in Sy.No.73 to an extent of Ac.6.20 cents and in Sy.No.31/2 to an extent of Ac.1.00 of Kashinagaram Village, Dummugudem Mandal, Khammam District, as illegal and arbitrary and for a consequential direction to the 1st respondent to pass appropriate orders in accordance with law after giving notice to the effected parties.
Though counter is filed stating that enquiry for cancellation of Pattadar Pass Books granted in favour of 4th respondent is pending, but in the counter filed on 25.06.2013 in another connected writ petition No.21554 of 2003, goes to show that Pattadar Pass Books granted in favour of 4th respondent were cancelled by order dated 18.06.2013 by the concerned authority. In view of the same, learned counsel for the petitioner and learned Assistant Government Pleader for Revenue states that the cause in the writ petition does not survive for adjudication.
Accordingly, the writ petition is dismissed as infructuous. No order as to costs.
As a sequel thereto, miscellaneous applications, if any, pending in the writ petition, shall stand closed. ____________________________ A.RAJASHEKER REDDY, J 29.02.2016 tk.
