T.Venkatapathi v. State Of Telangana
THE HONOURABLE SRI JUSTICE M.S.RAMACHANDRA RAO Writ Petition No.20834 of 2019 ORDER :
Heard the counsel for petitioners, and the learned Government Pleader for Revenue for respondents.
2.
This Writ Petition is filed challenging the order dt.02.09.2008 passed in Case No.F2/20/2007 by 2nd respondent in an appeal under Section 24 of the Andhra Pradesh (Telangana Area) Abolition of Inams Act, 1955.
3.
In the affidavit filed in support of this application, it is stated that though counsel had been engaged by petitioners' father who had filed the said appeal before the 2nd respondent, the petitioners' father was not keeping good health and could not get in touch with the counsel, and later died on 23.02.2012. It is contended that petitioners were not aware of the same even though 5th petitioner was a practising Advocate, and later they discovered about this order and filed Writ Petition.
4.
Admittedly, this Writ Petition is being filed more than eleven
(11) years after the order was passed by 2nd respondent on 02.09.2008. The father of petitioners had engaged a counsel before the 2nd respondent who represented the interests of petitioners. It was the duty of petitioners to keep track of the proceedings even if their father

was unwell and had died subsequently on 23.02.2012, particularly when the 5th petitioner is said to be a Lawyer. 5.
The Law of Limitation is based on public policy that settled matters should not be disturbed, and that an unlimited period of limitation would cause chaos in society.
6.
In this view of the matter, I am not inclined to entertain the Writ Petition at this point of time since it is barred by laches. 7.
Accordingly, the Writ Petition is dismissed as above. No order as to costs.
8.
As a sequel, miscellaneous petitions pending if any in this Writ Petition, shall stand closed.
