HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.18233 of 2018 ORDER:

The petitioner apprehending mutation in favour of 5th respondent for the agricultural lands in Sy.Nos.264, 265, 266, 267, 268, 269, 270, 271, 272, 273 and 275 of an extent of Ac .22-21 gts., situated at Iyanapur Village, Dhoma Mandal, Vikarabad District, filed objections on 25.10.2017.

The petitioner now prays for a direction to 4th respondent to consider the objections dated 25.10.2017 within a reasonable time.

I have heard the learned counsel for petitioner and perused the record.

Prima facie, this Court is of the view that the objections now filed are more in the nature of caveat lodged by petitioner informing the 4th respondent about the interest the petitioner claims with regard to survey numbers, referred to above. It can be appreciated if it is shown to the Court that an application is taken on file and the matter is proceeded with without reference to the objections dated 25.10.2017 and then to avoid multiplic ity of legal proceedings, appropriate directions can be issued.

Now without knowing whether a case for mutation is pending or not directing 4th respondent to consider objections would be an exercise in futility under the scheme of the A.P.Rights in Land and Pattadar Pass Books Act, 1971. The petitioner filed objections on 25.10.2017. The 4th respondent is required to consider the objections, if takes up mutation for the survey numbers, referred to above or change the entries to the detriment of petitioner. For any reason, the 4th respondent if fails to comply with the statutory requirements, the petitioner has the remedy of appeal.

With the above observations, the writ petition is disposed of. No order as to costs.
