HON'BLE SRI JUSTICE M. SATYANARAYANA MURTHY CRIMINAL PETITION No.7871 OF 2013 ORDER:

This criminal petition, under Section 482 of the Code of Criminal Procedure, 1973 (for short 'Cr.P.C.'), is filed by the petitioner/A.8 to quash the proceedings in C.C. No.498 of 2013 pending on the file of XI Special Magistrate, Erramanzil, Hyderabad.

The second respondent filed a complaint against the petitioner and others for the offence punishable under Sections 138 and 141 of the Negotiable Instruments Act, 1882 on the ground that the petitioner issued a cheque towards discharge of the legally enforceable debt, on its presentation, it was dishonoured, and after compliance of Section 138(b) of Negotiable Instrument Act, as the petitioner and others failed to comply the legitimate demand for payment of the amount covered by the cheque.

Sri P.Sri Harsha Reddy, learned counsel for the second respondent, has reported no objection to allow the criminal petition.

In view of no objection reported by the learned counsel for the second respondent, the criminal petition is allowed quashing the proceedings in C.C. No.498 of 2013 pending on

- 2 - MSM, J Crl.P. No.7871 of 2013 the file of XI Special magistrate, Erramanzil, against the petitioner.

Miscellaneous petitions, if any, pending in this criminal petition shall stand closed.
