THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 31654 OF 2017 O R D E R:
The grievance of the petitioner in this writ petition is that in spite of his complaint, dated 26.07.2017, respondent No.3-Station House Officer, Krishnagiri Police Station, Kurnool District is not registering the FIR.
Learned Government Pleader for Home (Andhra Pradesh), placed before this Court, the written instructions, wherein it is stated as under:
"It is pertinent to mention here the writ petitioner herein has disputes with his brothers members in connection with the landed property situated in Survey No.403 of Padirlapalli Village of Krishnagiri Mandal. In connection with the said issue, an altercation was taken place between the writ petitioner and his brothers. Basing on the same, both of them submitted complaint against each other.
Basing on the said issue, the brother of the writ petitioner submitted a report before the 3rd respondent herein and a case in Crime No.50 of 2017 of Krishnagiri Police Station was registered against two persons, i.e., the writ petitioner and his son, for the offences under Sections 447 and 324 read with Section 34 IPC.
In connection with the same issue, the son of the writ petitioner submitted a report before the 3rd respondent herein and a case in Crime No.51 of 2017 of Krishnagiri Police Station was registered against one person (de-facto complainant in Crime No.50 of 2017) for the offences under Sections 447, 324 and 506 IPC. Both cases are under investigation."
In the light of the above, since Crime No.51 of 2017 has already been registered, liberty is given to the petitioner to work
out the remedies in accordance with law. However, respondent No.3 is directed to complete the investigation and take necessary steps.
The writ petition is accordingly closed.
Consequently, the miscellaneous petitions, if any shall stand closed.
