HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 19304 of 2016 ORDER:

Heard learned counsel for the petitioner, Sri P.Keshava Rao, learned Standing Counsel for G.H.M.C., and Sri Chatla Madhu, learned Standing Counsel for respondent No.3Corporation.

There is no necessity to put the unofficial respondent on notice as this Court is not venturing to adjudicate the issue on merits.

The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the official respondents in not considering the complaints dated 17.02.2016 and 07.01.2016 submitted by the petitioner requesting them to take action against illegal construction made by respondent No.4 without any valid permission while encroaching public road over the house property bearing No. 12-7-16 & 17, Mettuguda, Secunderabad, as illegal, arbitrary and violative of principles of natural justice; and consequently direct respondent Nos.2 and 3 to stop the further illegal construction of respondent No.4 and remove the same.

Though various grounds are raised in the writ petition, learned counsel for the petitioner restricts his prayer seeking a direction to respondent Nos.2 and 3 to dispose of the complaints dated 17.02.2016 and 07.01.2016 at the earliest. Without going into the merits of the case and having regard

to the facts and circumstances of the case, the present writ petition is disposed of, directing respondent Nos.2 and 3 to dispose of the complaints dated 17.02.2016 and 07.01.2016 made by the petitioner, in accordance with law, as expeditiously as possible, preferably within a period of four (04) weeks from the date of receipt of a copy of the order, after hearing the petitioner and un-official respondent No.4, if the same are made and still pending consideration. No order as to costs. Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
