THE HON'BLE SRI JUSTICE U.DURGA PRASAD RAO Crl.P.M.P.No.17075 of 2014 in Crl.P.No.15937 of 2014 and Crl.P.No.15937 of 2014 Common Order:

The defacto complainant-Shaik Gouse @ Shaik John Basha and LW.2-Shaik Asif (injured-victim) and their counsel Sri B.Sarvotham Reddy are present. Accused No.1-Atchi China Narasimharao @ China Babu and his counsel Sri P. Nagendra Reddy are present.

Heard both sides and perused the petition.

The Police of Nandigama P.S laid charge sheet in Crime No.435 of 2012 against A.1 to A.12 for the offences under Sections 143, 147, 148, 324, 506 r/w 149 IPC and the learned Additional Judicial First Class Magistrate, Nandigama took cognizance of the case and registered in C.C.No.471 of 2013.

While-so, the defacto complainant, LW.2 and A.1 who are now present in the Court submitted that at the intervention of the elders, they entered into a compromise by amicably resolving their disputes and therefore, the permission may be accorded to them to enter into compromise and record the compromise and quash the proceedings in C.C.No.471 of 2013 on the file of Additional Judicial First Class Magistrate, Nandigama as

against A.1.

In view of the above submission and having regard to the fact that the parties have amicably settled their disputes and no purpose will be served even if they are driven to trial since they compromised and by following the decision reported in Gian Singh v. State of Punjab and another[1], this Criminal Miscellaneous Petition is allowed and permission to compromise is accorded in terms of the accompanying memo filed by both parties and consequently the proceedings in C.C.No.471 of 2013 on the file of Additional Judicial First Class Magistrate, Nandigama are hereby quashed as against A.1-Atchi China Narasimharao @ China Babu.

In the result, both the petitions are accordingly disposed of.

As a sequel, miscellaneous petitions pending, if any, shall stand closed.
