HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND THE HON'BLE SRI JUSTICE S.V. BHATT WRIT PETITION No. 41423 of 2015 PC: (per the Hon'ble the Acting Chief Justice Dilip B. Bhosale) Heard learned counsel for the parties.
Learned counsel for the petitioners submits that the petitioners got custody of the child, who was allegedly kidnapped by respondent Nos.5 to 9. Respondent Nos.5 to 9 are also close relatives of the child from his mother side. Parents of the child died in accident and the petitioners are the only persons living in their family and they are issueless and presently, the child is with them. In view thereof, nothing further survives in the writ petition. Writ petition is disposed of. It is open to respondent Nos.5 to 9 to file appropriate proceedings before the appropriate Court if they so desire and advised for seeking custody of the child. If any such proceedings are filed, the concerned Court shall consider and decide the same on merits in accordance with law and uninfluenced by this order. It is further made clear that under any circumstances, none of the private parties shall make any endeavour to forcibly take away the child with them.
