HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.11875 of 2015 ORDER:

This criminal petition is filed by the petitioner - Accused No.1 under Sections 437 and 439 of Criminal Procedure Code seeking to grant bail in Crime No.46 of 2015 on the file of Rajavommangi Police Station, for the offences under Sections 8 (c) r/w.20(b) (ii) of the NDPS Act.

Heard and perused the material available on record. The allegation against the petitioner is that he involved in illegal business of ganja.

Learned counsel for the petitioner submitted that the petitioner is no way concerned with the offences alleged against him and nothing was recovered from him.

Learned Public Prosecutor submitted that on the basis of confession of A2 to A19, those who were in possession of a huge quantity of 420 kgs., of ganja, that the petitioner is behind the entire episode, the petitioner was arrested and that he is involved in five other cases also.

Considering the above facts and circumstances of the case, this court is not inclined to grant bail to the petitioner at this stage. Accordingly, the Criminal Petition is dismissed. _______________ RAJA ELANGO, J November 20, 2015.
