THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM COMPANY PETITION No. 26 OF 2013 O R D E R:

This Company Petition has been filed seeking winding up of the respondent Company.

The Company Petition was admitted on 28.04.2014 and thereafter, the matter underwent several adjournments. On an earlier occasion, when it was represented that there is a connected Company Petition, being C.P.No.25 of 2013 filed against the respondent and it is pending, this Court directed the Registry to post the present Company Petition along with C.P.No.25 of 2013.

Now, it is brought to the notice of this Court that as a matter of fact, this Court passed order on 03.08.2015 in C.P.No.25 of 2013, which was filed at the instance of the petitioner therein i.e. M/s.Premier Global Logistics Limited, for winding up of the respondent.

In those circumstances, no orders are required to be passed in the present C.P. as the winding up of the respondent at the instance of a creditor would have been taken up and it would enure to the benefit of all the parties.

In those circumstances, the Company Petition is closed giving liberty to the petitioner to approach the Official Liquidator to make its claim.
