THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.1910 OF 2016 ORDER:
This Criminal Petition is filed under Section 482 of Code of Criminal Procedure (Cr.P.C) by the petitioners-accused Nos.1 and 2 seeking to quash the proceedings in FIR No.18 of 2016 of IV Town Police Station, Nellore, SPSR Nellore District, registered for the offence under Section 3 (1) (x) of the Scheduled Castes and Scheduled (Prevention of Atrocities) Act. Heard the learned counsel for the petitioner and the learned Public Prosecutor and perused the material available on record.
The allegation against the petitioners is that they abused the de facto complainant in the name of his caste in a petty quarrel.
Learned counsel for the petitioners submitted that the petitioners are innocent of the offence alleged against them and that the petitioners are apprehending arrest in view of the pendency of the above crime and they are ready to cooperate with the investigation.
Having regard to the facts and circumstances of the case and also in view of the nature of offence alleged against the petitioners, this Court is not inclined to interfere with the proceedings against the petitioners. However, in view of the submission of the learned counsel for the petitioners that the petitioners are apprehending arrest in view of the pendency of the above crime, the police concerned are directed to complete the investigation without arresting the petitioners and file final report in accordance with law. The petitioners are directed to appear before the Investigating Agency as and when their presence is required, and cooperate with the Investigating
Agency.
With the above direction, the Criminal Petition is disposed of. Consequently, miscellaneous petitions pending if any, shall stand closed.
