THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.3771 OF 2016 ORDER:

The Criminal Petition is filed under Section 482 of Code of Criminal Procedure (Cr.P.C.) to quash the proceedings in C.C.No.184 of 2013 on the file of the Court of the II Additional Judicial First Class Magistrate, Bhimavaram, arising out of offence under Section 489(B) (C) IPC.

Heard and perused the material available on record. Learned counsel for the petitioner submits that at the time of registration of crime on 06.10.2013, the petitioner was not present and he was detained in presidency correctional home at Government of West Bengal, and that he was in prison from 18.06.2013. The allegation against the petitioner herein as per the charge sheet is that the petitioner supplied the currency notes, which are fake in nature to the other accused and not that he was at the place of occurrence where the currency notes are seized. Hence, this Court is not inclined to quash the proceedings against the petitioner. The Criminal Petition is accordingly dismissed.
