THE HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No.22665 of 2015 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for Civil Supplies for respondents.

2. The petitioner was appointed as a permanent fair price shop dealer of Shop No.99 of Dharmavaram Town, Anantapur District. When respondents 3 to 9 threatened the petitioner to resign and give up the dealership, she filed W.P.No.17393 of 2014 and this Court disposed of the same directing the respondents to supply the stock. Thereafter the authorization of the petitioner was suspended on 05.09.2014. Challenging the same, the petitioner filed W.P.No.28143 of 2014 and this Court, by order dated 05.09.2014, set aside the order of suspension. While so, the fifth respondent inspected the shop on 10.03.2015 and submitted a report to the fourth respondent. The fourth respondent, in turn, submitted a report to the third respondent and basing on the same, the third respondent issued a show cause notice on 29.03.2015 alleging certain allegations against the petitioner. The petitioner submitted her explanation on 02.04.2015. After receiving the explanation, the impugned order of suspension was passed on 01.06.2015. Challenging the same, the present Writ Petition filed. 3.

It appears that pursuant to the inspection conducted on 10.03.2015, 6-A proceedings were initiated and they are pending against the petitioner. Four charges were leveled against the petitioner pursuant to the report of the fourth respondent dated 19.03.2015.

The petitioner submitted her explanation on 02.04.2015 and the matter is pending consideration before the third

respondent.

In view of the pendency of the enquiry in respect of the specific allegations, this Court is not inclined to interfere with the enquiry process at this stage. However, the third respondent is directed to conduct an enquiry in respect of the allegations against the petitioner and complete the same within a period of 30 days from the date of receipt of a copy of this order.

5. The Writ Petition is, accordingly disposed of. No order as to costs. Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
