This Criminal Petition is filed under Section 480 & 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 by the petitioner praying this Court to enlarge him on bail who is arrayed as accused No.1 in COR No.45 of 2026 of Prohibition & Excise, Kachiguda. The offences alleged against the petitioner are under Sections 8(c) r/w.22(b) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short 'NDPS Act').

The case of the prosecution is that on 07.05.2026 at about 10:48 PM, the Prohibition & Excise Sub-Inspector of STF

- 2 - along with their team conducted route watch on the road near Radha Nilayam, Turabnagar, Amberpet, Hyderabad and detected a case of illegal sale and possession of MDMA (Psychotropic Substance) weighing 4.62 grams by the accused, which is transporting in a dark grey colour Baleno car and one black Electric Two Wheeler. The accused persons were arrested under the cover of panchanama and registered aforesaid case and produced before the Court concerned for judicial remand. 3.

Heard Ms. Swathi Sharma, learned counsel appearing for the petitioner and Sri D.Arun Kumar, learned Additional Public Prosecutor appearing for the respondent-State. 4.

The contention of learned counsel for the petitioner is that petitioner has been falsely implicated in the present case and the allegations against him are false and baseless. It is submitted that the alleged contraband was recovered from a car which does not belong to the petitioner, nor from his conscious possession. The petitioner was neither present in the said car nor on the alleged motorcycle at the relevant time and was, in fact, at his residence. It is further submitted that the investigation has already been completed and, therefore, his further detention is not necessary. Learned counsel also

- 3 - submitted that petitioner is a permanently disabled person, having lost his entire right hand and fingers of his left hand in an accident, and is dependent upon his wife for his day-to-day activities. It is further contended that Accused Nos. 2 to 4 have already been granted bail by this Court in Crl.P.No.8622 of 2026, dated 15.06.2026, and on the ground of parity, the petitioner is also entitled to be enlarged on bail. Hence, prayed this Court to enlarge the petitioner on bail. 5.

On the other hand, learned Additional Public Prosecutor opposed the same and submits that the offence alleged against the petitioner is punishable under the provisions of NDPS Act; that investigation is also not yet completed; that though the seized contraband is an intermediate quantity, at this stage, the petitioner is not entitled for grant of bail and prayed to dismiss this petition.

Considering the submissions made by learned counsel for both parties and perusal of the material on record, the petitioner has been in judicial custody from 08.05.2026 and the seized contraband is an intermediate quantity. Considering the period of incarceration of the petitioner in judicial custody, this

- 4 - Court deems it fit to grant bail to the petitioner subject to the following conditions:

i.

The petitioner shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each to the satisfaction of the learned IV Additional Chief Judicial Magistrate, Nampally, Hyderabad.

ii.

The petitioner shall appear before the concerned SHO between 09.00 a.m and 5.00 p.m., on every Monday for a period of eight (8) weeks or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.

iii.

The petitioner shall abide by the conditions stipulated in Section 483(2) of the BNSS.

Accordingly, the Criminal Petition is allowed. Miscellaneous petitions, if any, pending shall stand closed.
