This Writ Petition is filed for a Mandamus to set aside Notice, dated 08-01-2016, whereby respondent No.2 has directed the petitioner to remove the alleged encroachment to the extent of 11.25 square meters made by him over a public road.

The petitioner pleaded that on receipt of the said notice, he has submitted a representation and that having received the same, without passing any order, respondent No.2 has proceeded with the demolition of his building.

Mr.Md.Saleem learned Standing Counsel for respondent No.2- Municipality, submitted that this Court has disposed of several Writ Petitions, which were filed with identical grievance, with the direction to respondent No.2 to consider the representations of the petitioners therein, take decision thereon and communicate the same to the latter before proceeding further in pursuance of the impugned notices. The learned Counsel for the petitioner has not disputed this submission.

In view of the above facts, this Writ Petition is

disposed of with the direction to respondent No.2 to consider the petitioner's representation, dated 1901-2016, take a decision thereon and communicate the same to the latter before proceeding further in pursuance of the impugned notice.
