HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 21097 of 2016 ORDER:

The petitioner seeks a direction to respondents to grant permission for construction of compound wall by disposing her representation dated 31.05.2016.

The petitioner states that she purchased the agricultural land to an extent of Ac.0.21⁄2 gts. in Sy.No.14/EE. Subsequently, she applied for conversion of the said land into non-agricultural land for constructing house and the same was approved by the Revenue Divisional Officer, Nizamabad. The petitioner, thereafter, applied to the first respondent for sanction of the building plan. The first respondent accorded permission for construction of house but, however, directed to complete construction work on or before 25.06.2014. The petitioner states that, due to paucity of funds, she could not complete construction of compound wall and now intends to construct compound wall and, as such, made representation dated 31.05.2016 to the first respondent which is not being disposed of by the first respondent. Hence the Writ Petition.

Heard the learned counsel for the petitioner and the learned standing counsel appearing for respondents. A perusal of the sanctioned plan dated 26.06.2013 would disclose that permission was granted to the petitioner to construct house and the same to be completed by 25.06.2014. It is admitted by the petitioner that she could not complete the construction. In terms of G.O.Ms.No.67 dated 26.02.

Panchayat and seek renewal of the permission granted earlier. In as much as the petitioner has not made the application in terms of the prescribed rules, liberty is given to the petitioner to make application, in accordance with the rules, and it shall be considered and disposed of within a period of four weeks from the date of receipt of application. Needless to mention that the petitioner shall pay requisite fee prescribed under the rules. The Writ Petition is, accordingly, disposed of. Miscellaneous petitions pending, if any, shall stand dismissed. No order as to costs.
