THE HON'BLE SRI JUSTICE C.PRAVEEN KUMAR WRIT PETITION No. 19212 of 2016 ORDER :

The present Writ Petition came to be filed seeking to issue a writ of mandamus declaring the action of respondent No.3 in not investigating into crime No.63 of 2016 though it was registered on 18.04.2016 as illegal and arbitrary.

2. Heard the learned counsel for the petitioner and the Assistant Government Pleader for Home for the State of Telangana appearing for respondents 1 to 3. At the request of both the counsel, the Writ Petition itself is taken up for disposal at the stage of admission. Since this Court is not adjudicating the matter on merits, it may not be necessary to hear the unofficial respondents.

3. It is the grievance of the petitioner that though the aforesaid crime was registered on 18.04.2016, till date, police have not filed final report. Learned Assistant Government Pleader, on instructions, submits that the aforesaid crime was registered only on 18.04.2016 for the offences punishable under Sections 447, 504 and 506 read with 34 of the Indian Penal Code, 1860 and it may take some time for the police to complete the

investigation. However, he submits that the investigation will be completed as early as possible. Having regard to the circumstances of the case, respondent No.3 is directed to complete investigation in the aforesaid crime and file a final report, in accordance with law, as early as possible.

4. The Writ Petition is disposed of with the aforesaid direction. Miscellaneous petitions pending, if any, in the Writ Petition shall stand closed in the light of this final order. No order as to costs.
