HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 15917 of 2017 ORDER:

The inaction of respondent Nos.1 to 4, in acting on the complaint of the petitioner to demolish the illegal construction made by respondent No.5, in plot Nos.308 and 309, Sy.No.66/3, Raidurg Nav Khalsa Village, Serilingampally Mandal, Ranga Reddy District, is questioned in this Writ Petition as being illegal and arbitrary.

Petitioner states that respondent No.5, having obtained permission for stilt + four floors, is making construction against sanctioned plan without leaving setbacks, and even encroached public road. Though complaint was made as against the illegal construction made by respondent No.5, no action has been taken till date. Hence the writ petition. Sri Sampath Prabhakar Reddy, learned Standing Counsel for respondent Nos.2 to 4, would submit that, Greater Hyderabad Municipal Corporation had already issued notices, under Sections 452(1) and 461(1) of the Hyderabad Municipal Corporation Act, 1955; and necessary action would be taken only after considering the explanation submitted by respondent No.5.

Respondent - Corporation had since issued notices for the alleged deviations in the construction made by respondent No.5, the Writ Petition is closed. It is made clear that the respondent - Corporation shall take appropriate action in accordance with law.

Miscellaneous petitions pending, if any, shall stand closed. No order as to costs.
