HONOURABLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.25449 OF 2002 ORDER:

When this matter is taken up for hearing, none appeared for the petitioner.

It is informed by the learned Standing Counsel for the respondents that the Corporation imposed penal rent of Rs.3,35,705-24 ps., on the petitioner for sub-letting the quarter allotted to him, and challenging the same, the petitioner filed this writ petition and this Court passed interim order suspending recovery of the said penal rent from the salary of the petitioner. He further submitted that during the pendency of this writ petition, the petitioner attained the age of superannuation and in view of the interlocutory order, the respondents could not recover the penal rent from the petitioner, and the cause in this writ petition does not survive and therefore, the writ petition may be closed.

Recording the above submissions, the Writ Petition is closed. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
