THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION NO.26234 of 2016 ORDER:

This Writ Petition is filed for the following relief: "... to issue a writ of Mandamus or any other appropriate Writ Order or orders, Direction or Direction to declare the proceedings of the 2nd respondent in Draft Memo No.G2/19134/2011, dt.01-12-2011 as illegal, without jurisdiction and Unconstitutional and to issue consequential direction to the 4th respondent to receive the document that may be presented by the petitioners for registration in respect of petitioner's House No.11-465/5, assessment No.3498, for an extent of East-west 30 fts., North-South 60 Fts., or 200 Sq.yards, in Sy.No.190/2, situated at Podili Village & Mandal, Markapuram Revenue Division, Prakasam District, without reference to the memo of the 2nd respondent bearing No.G2/19134/2011, dated 01.12.2011 and to pass such other order or orders as this Hon'ble Court may deems fit just and proper in the circumstances of the case."

Learned counsel for the petitioner as well as learned Government Pleader for Revenue (Andhra Pradesh) submits that the issue involved in this writ petition is covered by orders of this Court in W.P.No.24316 of 2013 an batch dated 05.09.2013 as well as W.P.No.4595 of 2015 and batch dated 04.03.2015. Following the same, this Writ Petition is allowed setting aside the Draft Memo dated 01.12.2011. There shall be consequential direction to the Sub-Registrar, Podili, Prakasam District, to receive and process the documents presented by the petitioner in respect of the subject property without reference to the order dated 15.03.2011 of the High Court of Madras in Contempt Petition No.1205 of 2010. In the event the documents presented are found to fulfill the requirements of the Registration Act, 1908 and the Indian Stamp Act, 1899, the SubRegistrar, Podili, shall complete the registration formalities and release the documents in accordance with the due procedure.

As a sequel the miscellaneous petitions, if any pending in this Writ Petition, shall stand closed. There shall be no order as to costs. _____________________________ CHALLA KODANDA RAM, J.
