HONOURABLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.11937 of 2013 ORDER:

Petitioner was placed under suspension on the allegation of involvement in criminal case. Petitioner was also one of the accused in Calendar Case No.147 of 1998 on the file of IV Additional Judicial Magistrate of First Class, Chittoor. Praying to grant regularization of period of suspension, during pendency of the investigation and trial, co-accused in C.C.No.147 of 1998 filed WP No.6599 of 2013. The said writ petition is allowed as under: "8. The writ petition is accordingly allowed and the respondents are directed to pay terminal benefits to the petitioner within a period of six weeks from the date of receipt of a copy of this order. Since denial of the terminal benefits to the petitioner was on illegal grounds, he is also entitled to interest on all the retirement benefits from the date of his retirement till the date of payment at 7% per annum. There shall be no order as to costs.". 2.

When the matter is called for consideration, learned counsel for petitioner as well as learned counsel representing respondents submit that subject matter of the writ petition is covered by the decision of this Court in W.P.No.6599 of 2013 and that both petitioners are involved in the same crime.

For the reasons alike, this writ petition is also allowed directing the respondents to pay retirement benefits to the petitioner within a period of six weeks from the date of receipt of a copy of this order. Since denial of the retirement benefits to the petitioner was on illegal grounds, he is entitled to interest on all the retirement benefits from the date of his retirement till the date

of payment at the rate of 7% per annum. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
