Petitioner retired from service on 30.04.2019. While in service, he was issued charge memo dated nil-02-2018 containing four charges. Petitioner contends that there is no further progress in the disciplinary proceedings and on the ground that disciplinary proceedings are pending, his retirement benefits are not settled. According to the learned counsel for petitioner, criminal case is also launched against the petitioner and criminal case is also pending.

Learned Government Pleader submits that on 26.07.2018 Enquiry Officer was appointed and reminder was also given to him on 30.03.2019, but Enquiry Officer has not completed the enquiry. 3.
Admittedly, there is no progress in the enquiry and it appears, petitioner is not responsible for the delay in finalization of disciplinary proceedings. For the reasons best known, the disciplinary authority kept quiet and not taken any action against the enquiry officer in not completing the enquiry within the time stipulated and prolonging the issue.

Having regard to the fact that petitioner retired from service and when petitioner has no objection to complete the enquiry, even though criminal cases are pending, the 1st and 2nd respondents are directed to finalize the disciplinary proceedings and take appropriate decision as warranted by law as expeditiously as possible, preferably within a period of three months from the date of receipt of copy of this order. If the enquiry officer is not taking
interest in conducting enquiry within the stipulated time, it is open to petitioner to approach the Commissioner to take action against the enquiry officer. Petitioner is also directed to cooperate in conducting enquiry. Writ Petition is accordingly disposed of.
