This Writ Petition is filed under Article 226 of the Constitution of India seeking a Writ of Mandamus declaring the inaction of the respondents in providing the electricity supply pursuant to the Registration Acknowledgment dated 09.04.2015 is arbitrary and illegal and violative of Article 14 of Constitution of India and consequently to direct the respondents to forthwith provide the electricity supply pursuant to the Registration Acknowledgment dated 09.04.2015 to the petitioner's property bearing plot No.23-B, covered by Block No.38, T.S.No.1002 of Walt-air Ward (Walt-air uplands), Visakhapatnam. Heard the learned counsel for the petitioner and Sri M.Ravindra, the learned Standing Counsel for the respondents. The case of the petitioner is that she is having an extent of 201 square yards with asbestos sheet shed bearing plot No.

23-B, covered by Block No.38, T.S.No.1002 of Walt-air Ward (Walt-air uplands), Visakhapatnam. The petitioner purchased the same under a registered sale deed dated 29.11.2012. The petitioner applied for electricity service connection by paying requisite amount of Rs.2,050/- and the same was acknowledged by the respondents on 09.04.2015. The grievance of the petitioner is that the respondents are not providing electricity service connection to the petitioner even though she complied with all the necessary formalities. The learned Standing Counsel submitted that the respondents cannot provide electricity service connection to the property in dispute. The petitioner submitted representations on 01.05.2016 and 01.06.2016 (legal notices) requesting the respondents to provide electricity service connection to the petitioner's house.

respondents have not taken any steps to pass appropriate orders on the representations of the petitioner.

The learned counsel for the petitioner submitted that the respondents may be directed to dispose of the representations submitted by the petitioner.

The learned Standing Counsel, in all fairness, submitted that the respondents have no objection to dispose of the representations in the light of the Electricity Act.

Having regard to the facts and circumstances of the case, the second respondent is hereby directed to dispose of the representations of the petitioner dated 01.05.2016 and 01.06.2016 in accordance with law, after affording a reasonable opportunity to the petitioner, as expeditiously as possible, preferably within a period of one (1) month from the date of receipt of a copy of this order. Accordingly, the Writ Petition is disposed of. No costs. Consequently, Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
