THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.8003 of 2013 ORDER:
On 06-02-2013, the petitioner represented to the 4th respondent for removing encroachment to an extent of two acres of land in Sy.No.126/ H/ 4 of Kallepally Village, Bejjanki Mandal, Karimnagar District. Now the grievance of petitioner is that assignment is granted in respect of subject matter of the writ petition and the authorities are not enquiring into the encroachment made by the 5th respondent. The writ petition was filed in the year 2013 and notice before admission was ordered on 17-04-2017.
Learned Assistant Government Pleader requests time for filing counter affidavit.
This Court is of the view that instead of granting time for filing counter affidavit, the 4th respondent can be directed to look into the representation of the petitioner. Hence, the writ petition is disposed of by this order.
The petitioner is given liberty to re-submit representation dated 06-02-2013 by enclosing a copy of this order before the 4th respondent within four weeks from the date of receipt of a copy of this order. The 4th respondent is directed to examine the grievance and take a decision, after affording opportunity to the persons if any interested in the subject matter of land, within three months thereafter.
