THE HONOURABLE SRI JUSTICE RAJA ELANGO COMPANY APPLICATION No.442 OF 2017 IN R.C.C.No.2 OF 1995 ORDER:

This Company Application is filed by the applicant under Section 462 of the Companies Act, 1956 read with Rules 9, 302 and 309 of the Companies (Court) Rules, 1959 seeking the following relief:- "i) take the audit report dated 15-02-2017 for the periods 01-04-2014 to 31-03-2015 and 01-04-15 to 31-03-2016 submitted by M/s.

T.Badarinath & Associates Chartered Accountants on the Estate and Establishment Fund and Company paid Staff Terminal Benefit Fund A/c on record ii) permit the Official Liquidator to pay Audit fee of 35,000/- and service Tax as applicable for each financial year from the Estate and Establishment Fund A/c to the said Auditor. iii) order that the cost of this application do come out of the Estate and Establishment Fund A/c."

Considering all the facts and circumstances of the case and in view of the fact that the Official Liquidator is not having any objection with regard to the report of the auditor, this Company Application is allowed.
