HON'BLE SRI JUSTICE S.V. BHATT Writ Petition No.23787 of 2017 ORDER:

Heard Mr.Mohammed Habeebuddin for petitioner and the Assistant Government Pleader (Revenue) for respondents.

2. The petitioner complains against inaction of respondents in considering and disposing of the representation dated 03.07.2017, as illegal and arbitrary.

3. On 19.07.2017, at request of the Assistant Government Pleader, the writ petition is directed to be listed today for admission to get instructions or file counter-affidavit in the matter. The Assistant Government Pleader, makes his statement basing on written instructions dated 20.07.2017.

4. According to the 1st respondent, the representation of the petitioner is pending as on date and the preliminary enquiry into the matter reveals that a comprehensive enquiry and decision into the representation of the petitioner dated 03.07.2017 as well as on the alleged encroachment or interference into neighbouring land by Pitla Bali Reddy S/ o Raghurami Reddy is also required to be carried out. Therefore, the Assistant Government Pleader requests two months time to dispose of the representation along with the complaint of encroachment into neighbour's land by Pitla Bali Reddy as well. The 1st respondent issues notice to both parties, proceeds in accordance with law and passes final orders, within two months from the date of receipt of a copy of this order. The statement is placed on record.

5. The writ petition is, accordingly, disposed of. No order as to costs. Pending miscellaneous petitions if any in this writ petition shall stand dismissed in consequence.
