THE HON'BLE SRI JUSTICE C.PRAVEEN KUMAR WRIT PETITION No. 19425 of 2016 ORDER :

Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Mines and Geology for the State of Andhra Pradesh. At the request of both the counsel, the Writ Petition itself is taken up for disposal at the stage of admission.

2. Since this Court is not adjudicating the case on merits, it is not necessary to issue notice to respondents 8 to 10.

3. The present Writ Petition came to be filed with the following prayer:

"... to issue a Order, Direction or Writ, more particularly one in the nature of Writ of Mandamus, declaring the inaction of the respondent Nos. 1 to 7 in taking action against respondent Nos. 8 to 10 in pursuant to the representation dated 19.4.2016 made by the petitioner as illegal, arbitrary and against the settled principles of law and consequently direct the respondents 1 to 7 to consider the representation of the petitioner dated 19.4.2016 and take action against the respondents 8 to 10 in accordance with law and to pass.... "

4. Though various grounds are raised in the Writ Petition, learned counsel for the petitioner seeks a

direction to respondent No.6 to consider the representation dated 19.04.2016 made by the petitioner bringing to the notice of the authorities the illegal quarry operations being carried on by respondents 8 to 10 and pass appropriate orders thereon. Learned Assistant Government Pleader submits that no representation has been made by the petitioner till date except got issuing a lawyer's notice dated 19.04.2016.

In view of the submissions made and having regard to the circumstances of the case, without going into merits of the case, respondent No.6 is directed to treat the notice dated 19.04.2016 got issued by the petitioner as a representation and pass appropriate orders thereon in accordance with law as early as possible preferably within a period of eight weeks from the date of receipt of a copy of this order. It is needless to mention that respondent No.6 shall hear the petitioner and also respondents 8 to 10 before passing any order on the representation.

6. The Writ Petition is disposed of with the aforesaid direction. Miscellaneous petitions pending, if any, in the Writ Petition shall stand closed in the light of this final order. No order as to costs.
