THE HONOURABLE SRI JUSTICE T.VINOD KUMAR W.P.No.21079 of 2019 ORDER:

This writ petition is filed questioning inaction on the part of the 2nd respondent, Additional Agent to the Government and Project Officer, ITDA, in passing any orders on the appeal filed by the petitioners challenging the orders passed by the 3rd respondent, Revenue Divisional Officer, vide Proceedings No.A/738/2018, dated 25.02.2019, though the petitioners filed the appeal on 27.05.2019.

Heard the learned counsel for the petitioners and the learned Government Pleader for Social Welfare for respondents.

It is submitted by the learned Government Pleader that the appeal filed by the petitioner though was received in the Inward Section of the 2nd respondent's office and the same appears to be not in the proper form.

It is clear from the material filed in the writ petition that the petitioner had preferred an appeal before the 2nd respondent and it is for the 2nd respondent to consider the said appeal and pass appropriate orders, in accordance with law, and if it is found not in the proper form, the same should be informed to the petitioner in writing so as enable him to meet the deficiencies pointed out by the 2nd respondent but

2nd respondent cannot keep the same without any communication to the petitioner.

Having regard to the above, this writ petition is disposed of directing the 2nd respondent, Additional Agent to the Government and Project Officer, ITDA, to consider the appeal stated to have been filed by the petitioner and pass appropriate orders, in accordance with law, within a period of two months, from the date of receipt of a copy of this order. There shall be no order as to costs.

As a sequel, miscellaneous applications, if any pending, shall stand closed.
