THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.21536 OF 2017 ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief:- "to issue appropriate order or direction more particularly one in the nature of Writ of Mandamus and declare the inaction on the part of Respondent No.1 in taking appropriate action on the illegal construction of the Respondent No.3 in house bearing No.1-9-278/49/C2, Jamisthanpur Ramnagar, Hyderabad, as illegal and violation of Sec.461(4), 596 and 636 of Hyderabad Municipal Corporation Act, 1955, consequently direct the respondent No.1 to remove unauthorized structure in house bearing No.1-9-278/49/C2, Jamisthanpur Ramnagar, Hyderabad." 2.

After arguing for sometime, learned counsel for the petitioner requested the Court to direct respondent No.1 herein to consider the representation, dated 10.04.2017, of the petitioner and take appropriate action in accordance with law.

Considering the facts and circumstances of the case and the grievance of the petitioner, without going into the merits of the case, respondent No.1 is hereby directed to consider the representation, dated 10.04.2017, of the petitioner and take appropriate action in accordance with law regarding the illegal construction alleged to have been made by respondent No.3 as expeditiously as possible.

Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
