THE HONOURABLE SRI JUSTICE T. VINOD KUMAR WRIT PETITION No.20943 of 2019 ORDER:

This writ petition is filed seeking a writ of mandamus declaring the action of the respondents in harassing and obstructing the petitioner from cultivating the land in Sy.No.347/EE to an extent of Ac.4.16 gts. situated at Mogilipaka Village, Valigonda Mandal, Yadadri Bhongir District, as illegal and arbitrary and sought consequential direction to the respondents not to interfere with the peaceful possession and enjoyment of the said land. 2.

Heard learned counsel for the petitioner and learned Assistant Government Pleader for Home.

Learned Assistant Government Pleader on written instructions, dated 24.09.2019, submits that the allegations made by the petitioner that the respondent police are harassing and obstructing him from cultivating his land is false and denied and the respondent police never harassed nor obstructed the petitioner from cultivating the land. He further submits that since a case in Crime No.111 of 2019 was registered by the 4th respondent against the petitioner, in order to pressurize the police officials from not investigating the case, he filed this present writ petition with false and frivolous allegations. 4.

Having regard to the said submission made by the learned Assistant Government Pleader, the 4th respondent is directed not to interfere with the peaceful possession and enjoyment of the petitioner

in relation to the subject land. However, the 4th respondent is at liberty to proceed with the investigation in connection with Crime No.111 of 2019 by issuing notice under Section 41-A Cr.P.C to the petitioner in case his presence is required and for conducting further enquiry/investigation in the matter in accordance with law. 5.

With the above observations, the writ petition is disposed of. Miscellaneous petitions pending, if any, shall stand closed. No costs.
