THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.32811 of 2012 ORDER:
This Writ Petition was filed challenging the action of the respondent Police in not investigating the crime in FIR No.142 of 2012 on the file of the 3rd respondent, IV Town Police Station, Kurnool, from the angle of homicide in spite of the petitioner's repeated requests to record her statement and other relatives' statements. A counter affidavit is filed by the Sub Inspector of Police, IV Town Police Station, Kurnool, who is the third respondent in this Writ Petition, stating that in view of the family disputes, the mother of the petitioner, being vexed with the disputes, poured kerosene over her body and set fire to herself in her room and committed suicide on 18.06.2012 at about 23.00 hours. She was aged about 70 years and no foul play was suspected over her death.
The investigation disclosed that it was a case of suicide, but not homicide, as alleged in the affidavit. The statement of the petitioner under Section 161 Cr.P.C was recorded and in view of her grudge against her own brother, the petitioner tried to divert the attention of the investigating agency. The petitioner attended the inquest and none of the witnesses including the petitioner spoke anything about the cause of the death of the deceased. In the complaint given by her brother, the petitioner signed as a witness, but she did not say anything about the cause of the death of her mother. In view of the above facts, the Writ Petition is dismissed as devoid of merits. The miscellaneous petitions pending, if any, shall stand closed.
